GENERAL TERMS AND CONDITIONS OF SALE 

Article 1. Scope of the GTCS

https://www.toursmarina.com, published by Marina Tours Fz LLC, is an online service that allows the User to order or book leisure and tourism services carried out in the city of Rome (and in general in Italy), Hungary, and the United Arab Emirates.

 These general terms and conditions of sale (“GTCS”) apply exclusively to orders or reservations made and paid for online on the Site by the User. The User is also expressly informed and acknowledges that the Services ordered or booked via the Site may be subject, in addition to these GTCS, to the general or specific terms and conditions of the Partner providers of the ordered Services. It is therefore the responsibility of the User to read these additional contractual conditions before purchasing Services on the Site.

Article 2. Definitions 

The terms used with a capital letter in these GTCS will have the meaning given below, whether used in the singular or plural.

 “Force Majeure” means an event such as a natural disaster or major political event (war, pandemic…), which, given its circumstances, is unpredictable, irresistible, and external, and which is recognized as such by the jurisprudence of the Court of Cassation as constituting a case of force majeure.“Partner” means the supplier(s) of the Services. “Service” means any service provided by Marina and/or a Partner, and that can be booked on the Marina Tours Site. The characteristics and contents of the Services are determined by Marina Tours and/or the Partner providing the said Services and are presented on the Site. “User” means any user of the Site who books one or more Services offered on the Site.

3.Ordering or Booking on the Site https://www.toursmarina.com

3.1 Prerequisites for Using the Service

 Any order or reservation made and paid for via the Site requires the User’s full and prior acceptance of these GTCS by checking the box provided for this purpose and, where applicable, acceptance of the applicable contractual terms of the Partner providing the concerned Service. Without this acceptance, proceeding with the order or reservation process is technically impossible. The characteristics of the Services that can be ordered or reserved on the Site are listed on the Site. The photos presented on the Site are not contractual. By placing an order or reserving a Service on the Site, the User implicitly acknowledges having obtained all the desired information on the nature and characteristics of this Service.The User must be at least 18 years old, legally capable of entering into a contract, and use this Site in accordance with the GTCS in effect on the date of validation of their order or reservation. The User certifies the truthfulness and accuracy of all information they provide to Marina Tours in the context of using the Service and guarantees Marina Tours against any action or claim from third parties regarding the unlawful or fraudulent use of their data by a User within the scope of using the Services.

3.2 Online Contracting Process Applicable to the Service

 3.2.1 These GTCS are offered in English. They can be consulted at any time from any internet page of the Site. 3.2.2 The procedure for placing an order or reservation on the Site by the User includes the following steps:

Step 1: Selection by the User of the desired Services after reviewing the essential characteristics of these Services as listed on the Site.

Step 2: Confirmation by the User of the information listed in the summary displayed on the Site, reminding the selected Services and the price due to Marina Tours.

Step 3: Filling in the mandatory fields of the order form on the Site (if not, the order or reservation request of the User cannot be processed by  Marina Tours), with the User being able to modify or abandon their order or reservation at this stage.

Step 4: Unreserved acceptance of these GTCS and, where applicable, the applicable contractual terms of the Partners.

Step 5: Final confirmation by the User of their order or reservation request on the Site after entering and validating the information related to the online payment method selected by the User for the payment of the price due to Marina Tours under the GTCS.

3.2.3 The online contract concluded by the User with Marina Tours becomes firm and final, and  Marina Tours is bound to provide the Service when the User has confirmed the selected Services and the price due to Tours Marina, filled in and verified the information entered in the mandatory fields of the order form, unreservedly accepted the GTCS and, where applicable, the contractual terms of the Partners, and paid the full price of the Services  directly to Tours Marina

 3.2.4 Tours Marina sends a confirmation email of the order placed by the User on the Site. This confirmation email is sent to the email address provided by the User in the order form. 3.2.5 It is the User’s responsibility to print the vouchers that they must present to the Partner to benefit from the ordered or reserved Services. The User must therefore ensure beforehand that they are able to print them. Otherwise, the User can present the vouchers directly on their smartphone to the Partner. In no case can the sole bank receipt serve as proof of reservation or order.

3.3 Modification or Cancellation of an Order or Reservation 3.3.1 The User’s attention is expressly drawn to the importance of verifying the accuracy of the entered information and correcting it if necessary, using the methods provided on the Site within the framework of the contractual process described in Article 3.2, before any final confirmation. Any order or reservation made on the Site is no longer modifiable online afterward. 3.3.2 However, the User may modify or cancel an order or reservation made on the Site only in the cases and under the conditions defined in Article 4 of these GTCS, or in the event of Force Majeure.

3.4 Absence of Right of Withdrawal In accordance with the provisions of Article L.121-20-4 of the Consumer Code, the User is informed that they do not have a right of withdrawal when booking or ordering “leisure services” remotely, whether they are booked or ordered on the Site together as a tourist package or separately, for a specific date or period.

Article 4. Conditions for Cancelling a Service

 4.1 Specific Conditions for Guided Tour Services 4.1.1 Cancellation by Marina Tours

Minimum of 4 people per tour for group tours. If not, participants are offered (at their choice): to switch to a private mode, to join a tour at a later date, or to cancel the tour. In case of cancellation, participants are fully refunded.

The guide reserves the exclusive and discretionary right to cancel a tour due to weather conditions (storm, extreme cold, heavy rain…). In such cases, the guided tour can be rescheduled to a later date with the participants’ agreement or canceled. In case of cancellation, participants are fully refunded), the refund applies only to the tour price and not to the ticket price; tickets once purchased are non-refundable.

4.1.2 Cancellation by the User

A cancellation request made more than 72 hours before the day of the tour entitles the User to a 50% refund of the tour price. Note: For tours with ticketing (e.g., Colosseum or Vatican), the refund applies only to the tour price and not to the ticket price; tickets are non-refundable.

A cancellation request made less than 72 hours before the day of the tour does not entitle the User to any refund.

4.3.2 Airport Pickup by a Guide + Transfer to Accommodation:

A cancellation request made more than 7 days before the day of the service entitles the User to a 50% refund of the service price.

A cancellation request made less than 7 days before the day of the service does not entitle the User to any refund.

Article 5. Liability of Marina Tours

Marina Tours cannot be held responsible for the total or partial non-performance of the contract due to an event of Force Majeure, a third party to the contract, or the fault of the User. In particular, Marina Tours cannot be held responsible for errors made by the User when entering the required information in online forms or in the event of fraudulent use by a third party of the User’s identity or payment methods identified during an order or reservation request. Marina Tours also cannot be held responsible for any damages of any kind resulting from the temporary unavailability of the Site or an interruption of the connection between the User’s terminal equipment and the Marina Tours Site during an order or reservation request. During Marina Tours Services, participants are under their own civil liability. Marina Tours disclaims all responsibility in the event of an accident during the Services.

Article 6. Conditions financières

 6.1 Common Provisions

 6.1.1 The prices of the Services mentioned on the Site are expressed in euros and/or USD and include all taxes. They take into account the VAT applicable on the day of the order or reservation request. The prices do not include communication fees related to the use of the Service, which remain the responsibility of the User. Ticket prices may be modified by Marina Tours in case of a reservation made less than 1 month before the service date (ticket prices may vary depending on the periods and require a reservation at least 1 month in advance).

6.1.2 The prices of the Services billed to the User correspond to the rates in effect on the day of the final confirmation by the User of the order or reservation request on the Site.

 6.1.3 Payment for the Services is made online at the time of reservation or order, by credit card, using the secure payment system offered on the Site. An invoice is issued and sent to the User by email.

6.2 Specific Provisions for Guided Tour Services

 6.2.1 Group Tours (for individuals and groups of more than 4 people):

Payment for the Services is made online at the time of reservation or order, by credit card, using the secure payment system offered on the Site. An invoice is issued and sent to the User by email.

6.2.2 Private Tours (for groups of less than 4 people):

50% of the total Service price is due at the time of online reservation on the Site, and the remaining 50% must be paid directly to the guide on the day of the Service.

6.2.3 Airport pick-up by a guide + transfer to accommodation:

The total price of the Service is payable at the time of reservation or order, by credit card, via the secure payment system offered on the Site. An invoice is issued and sent to the User by email.

Article 7. Data Protection

The information collected by Marina Tours is processed solely for the purposes of managing orders or reservations placed on the Site, including their execution and payment. In accordance with the European Data Protection Act of January 6, 1978, as amended, the User has the right to access, rectify, and delete personal data concerning them, as well as the right to object, for legitimate reasons, to their processing. The User can exercise their rights by writing to the address provided in the legal notices on the Site.

Article 8. Intellectual Property

8.1. All elements of the Site (texts, photos, illustrations, logos, downloadable files, video or audio clips, graphic charter, general structure of the Site, etc.) are protected by intellectual property law and are the exclusive property of Marina Tours or its partners, unless otherwise stated.

8.2. Any reproduction, representation, modification, adaptation, distribution, or exploitation, in whole or in part, of one or more elements of the Site, by any means whatsoever, without the express prior authorization of Marina Tours, is strictly prohibited and constitutes an infringement punishable by law.

Article 9. Applicable Law and Dispute Resolution

9.1. The General Conditions are subject to Italian law. Any dispute relating to their interpretation and/or execution will be submitted to the competent courts.

Article 10. Confidentiality

10.1. Personal Data

Marina Tours collects personal data concerning the User in the context of the Service provided on the Site, for its own account and/or on behalf of its Partners or service providers, in order to process and execute the User’s order or reservation on the Site. Marina Tours may thus transmit this data to third parties, including its Partners or service providers, to enable the User to benefit from the Services ordered or reserved on the Site.

The processing of personal data carried out by Marina Tours as data controller via the Site has been declared to the CNIL. The User’s personal data is processed by Marina Tours in compliance with the French Data Protection Act of January 6, 1978, as amended, whether as a data controller or processor for its Partners. The User is also informed that during their navigation on the Site, a cookie may be installed on their computer. The cookie stores information relating to the User’s navigation on the Site. The User is informed that they can oppose the installation of cookies at any time by configuring their browser accordingly.

10.2. Image Rights

Photographs and/or films may be taken during a Marina Tours service and then used by Marina Tours for promotional purposes. Participants in Marina Tours Services irrevocably authorize Marina Tours (or any person authorized by Marina Tours) to use and reproduce all photographs and/or films taken, in all formats and on all distribution media, to promote Marina Tours Services. This transfer of image rights is granted free of charge. The assignor cannot demand any remuneration for the use of their image by Marina Tours. The User can oppose the taking of photos and/or films of themselves (and/or persons registered under the same reservation) by using the provided email.

Article 11. Final Provisions

11.1. Severability

If any provision of these General Conditions is deemed invalid or unenforceable by a competent court, that provision will be deemed deleted without affecting the validity and enforceability of the remaining provisions.

11.2. Entire Agreement These general conditions constitute the entire agreement between the User and Marina Tours regarding the use of the service and replace any prior agreement or understanding, whether written or oral, relating to the subject matter hereof.

11.3. Modifications

Marina Tours reserves the right to modify these General Conditions at any time. The User will be informed of any changes by an appropriate notice on the Site. The modifications will apply to all orders or reservations made after the notice.
